Product Pricing
The prices listed on the Website (the "Price") for Modern Botany products the "Products") will be as stipulated at the time when you place your order on the Website except in the case of an obvious error. Prices quoted are inclusive of VAT, and do not include delivery charges. We are entitled to adjust the Price to take account of any increase in our supplier’s prices, or the imposition of any new taxes or duties, or if due to an error or omission the Price for the Products on the Website is wrong.
Product Descriptions
All Products displayed on this Website are available only whilst stocks last. All photos, descriptive matter specifications, and advertising issued on this Website and any descriptions photos or illustrations are issued or published for the sole purpose of giving an approximate idea of the Products described in them. They will not form part of the contract with you and no warranty or guarantee shall be expressed or implied in the contract with you. We do however take all reasonable care to ensure that all details, descriptions, and processes of Products appearing on the website are correct at the time that the relevant information was posted on the Website.
Due to the nature of some of our Products, variations in batches may occur. Some Products may differ from another even though the source, quantities and processing of the ingredients remain the same.
Reviews
You may be offered a discount or incentive for leaving a review. Incentives are given regardless of whether the review is positive or negative.
By submitting a review, you give us permission to use it in our marketing, including on our website, emails, ads, and social media.
Referral Program
You may refer friends to our store through our referral program. Referred friends receive a discount on their first order, and you may receive a reward once they make a qualifying purchase.
Referral rewards cannot be combined with other offers and are subject to change or withdrawal at any time. Referral misuse (e.g., self-referrals) may result in disqualification.
Rewards & Referrals
Discounts and rewards are offered through promotions, referrals, and loyalty programs. Referrals must be to new customers only. Self-referrals or referrals to existing customers aren’t eligible for rewards.
Offers may change or expire and can’t be combined. Misuse may result in removal from the program
Ordering Products
To order a Product please follow the ordering procedures set out on the relevant order page.
When placing an order you warrant that you are over the age of 18, that you are legally capable of entering binding contracts, and that all of the information supplied by you is accurate and complete.
After placing an order through this Website, you will receive an email from us acknowledging that we have received your order. Please note that this does not mean your order has been accepted.
By placing an order, you make an offer to us to purchase the Products you have selected. We may or may not accept your offer at our discretion. If we cannot accept your order we will contact you by email and shall refund any amount already paid to us. The contract between us will only be formed once we send you the confirmation of despatch.
We will always make every effort to supply you with the Products listed in your order confirmation. The contract existing then between you and us will relate only to those products whose despatch we have confirmed, in the confirmation of despatch. We will not obliged to supply any other products which may have been part of your order until the despatch of such products has been confirmed in a separate confirmation of despatch.
If We Cannot Accept or Fulfil Your Order
In some cases, we may be unable accept or fulfil an order from you, as a result of one or more of the following:
- The Product you ordered not being in stock.
- Our inability to obtain authorisation for your payment.
- An error in pricing or product description error.
- Unexpected limits on our resources which we could not reasonably plan for
- You not meeting the eligibility to order criteria, set out in these terms and conditions.
If we are unable to accept or fulfil your order, we will inform you of this via email, and issue a refund for the full amount paid, including any postage charges.
Delivery
We endeavour to dispatch your order within 2 to 3 business days. If your order is received after this time or is received over the weekend or on a bank or public holiday then it will be dispatched the next business day.
The delivery period given when you place your order is approximate. In the unlikely event that a Product you ordered is not in stock, we will contact you to inform you of the expected delivery date. Should you subsequently decide not to pursue your order, we will cancel same and issue you with a full refund.
If you are ordering more than one Product, your Products may be sent to you in multiple deliveries if certain Products are out of stock. We will contact you to inform you of any Products that are not in stock.
If you order Products from this Website for international delivery, they may be subject to import duties and taxes which are levied when delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
Please note that you must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable for any breach by you of any laws.
Please note during busy periods (for example, Christmas, Black Friday or promotional periods), there may be delays and delivery may take up to ten working days.
In some cases delivery of your order may require a signature. Please ensure that you will be available to sign for the delivery at the delivery address you have supplied.
Where our delivery partner is unable to make a delivery to you, either because you were not available at the address provided when delivery was attempted and did not collect the order within the time frame set out by the delivery partner or because the address you provided is incorrect or does not exist, and as a result your order is returned, we will make a charge to you for the costs we incur in sending the item to you and in paying for its return. We will issue you with a refund upon receipt of the parcel for the amount remaining after the deduction of these charges. We are responsible for any delay in the parcel being returned to us or if the delivery partner failed to notify you of an attempted delivery. Discount Codes & Promotions
Discount codes and/or promotions may be offered from time to time and may be subject to a limited time only. Discount codes and/or promotions cannot be applied retrospectively. Only one discount code may be used per transaction. Discount codes and offers cannot be redeemed on gift vouchers, sale or promotional items.
Where a promotional item is offered with purchase, there may or may not be a minimum spend requirement. Where a promotional item is offered it cannot be exchanged or refunded.
We reserve the right to withdraw promotions and/or discount codes at any time.

Notwithstanding the above, our liability in tort, contract, negligence, pre-contract or other representations or otherwise arising out of or in connection with these Terms shall be limited in aggregate to the net payment received by us for the Product concerned.
Force Majeure
1. If Modern Botany. is delayed or hindered in or prevented from performing any of its obligations under any order by reason of any event or circumstance beyond its reasonable control, Modern Botany. will have no liability to you in respect of such non-performance and the time for performing the same will be extended until the event or circumstance has ceased.
Ownership of Content
We create all of the images and descriptions used on this Website. All content available on the Website, including but not limited to text, graphics, logos, button icons, page layout, underlying code, images, audio clips, video clips, data compilations and software, and the compilation thereof (collectively, the “Content”) is the property of Modern Botany, our affiliates or other relevant third parties and is protected by Irish and international copyright laws. The taking of any Content by automated processes, such as spidering, will be deemed as a breach of copyright and is expressly forbidden except where specifically agreed with us or where we has expressly requested the process. The trademarks, logos, and service marks displayed on the Website (collectively, the “Trademarks”) are the registered and unregistered marks of Modern Botany, our affiliates, partners, or licensors, in Ireland and other countries, and are protected by Irish and international trademark laws. Severance
If any court of competent jurisdiction finds any provision of these terms and conditions to be void or unenforceable for any reason, then such provision shall be ineffective to the extent of the courts finding without affecting the validity and enforceability of any remaining provisions.

These terms and conditions of use and any disputes arising out of these terms and conditions shall be governed by and construed in accordance with the laws of Ireland.
